1. Agreement to Terms
By downloading, accessing, or using the CalorieTaker mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these terms, please do not use the App.
2. Service Description
CalorieTaker is a nutrition tracking application that uses artificial intelligence to provide:
- Meal logging and food photo analysis
- Nutritional information and calorie estimates
- Personal health insights and trends
- Progress tracking and goal management
3. Use of the App
3.1 Permitted Use
You agree to use the App only for personal, non-commercial purposes and in compliance with all applicable laws and regulations.
3.2 Prohibited Activities
You may not:
- Attempt to hack, reverse-engineer, or disrupt App functionality
- Use the App for commercial resale or unauthorized competition
- Harass, abuse, or threaten other users
- Upload illegal, defamatory, or harmful content
- Violate intellectual property or privacy rights
- Collect user data without authorization
3.3 Account Suspension
We reserve the right to suspend or terminate your account if you violate these Terms or engage in abusive behavior, without prior notice or liability.
4. User Accounts & Responsibility
4.1 Account Creation
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep it current.
4.2 Your Content
You retain ownership of all content you submit (photos, meal data, etc.). By using CalorieTaker, you grant us a non-exclusive, worldwide license to use, store, and process your data as described in our Privacy Policy.
4.3 Account Deletion
You may delete your account at any time through the App settings. Upon deletion, all personal data will be permanently removed in accordance with our Privacy Policy (usually within 30 days).
5. Subscription & Payment
5.1 Pro Subscription
CalorieTaker offers a free version and a Pro subscription with additional features including access to multiple AI models.
5.2 Billing
- Subscriptions are billed through Google Play (Android) or Apple App Store (iOS)
- Payment is charged to your account immediately upon subscription
- Renewals are automatic unless cancelled before the renewal date
5.3 Refund Policy
Refund requests should be directed to Google Play or Apple App Store according to their refund policies. We do not issue refunds directly.
5.4 Price Changes
We may update subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance of new pricing.
6. Intellectual Property
6.1 App Ownership
All content, features, and functionality of CalorieTaker (including logos, graphics, design) are owned by CalorieTaker or its licensors and are protected by copyright and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes only. You may not reproduce, distribute, or modify the App without permission.
7. AI Analysis & Accuracy
7.1 AI-Powered Features
CalorieTaker uses AI models (Gemini, Claude, OpenAI, Grok) for nutritional analysis. While we strive for accuracy, AI estimates may vary from actual values.
7.2 No Medical Guarantee
Nutritional estimates provided by the App are approximations only. Do not rely solely on these estimates for medical or dietary decisions. Consult a nutritionist or healthcare provider for personalized advice.
8. Limitation of Liability
To the maximum extent permitted by law, CalorieTaker and its creators, employees, and partners are not liable for:
- Any indirect, incidental, or consequential damages
- Loss of data, revenue, or business opportunities
- Health decisions or outcomes based on App data
- Third-party service interruptions (Google, AI providers, etc.)
- Inaccurate AI analysis or nutritional estimates
Your sole remedy is to discontinue use of the App.
9. Indemnification
You agree to indemnify and hold harmless CalorieTaker from any claims, damages, or costs arising from your violation of these Terms or misuse of the App.
10. Third-Party Services
CalorieTaker integrates with third-party services (Google Auth, Supabase, RevenueCat, AI providers). We are not responsible for their availability, accuracy, or data handling practices. Review their terms before using the App.
11. Integrations & AI Recommendations
By enabling integrations (for example, Google Fit) or AI features you agree that the minimal data required to enable those features may be shared with third‑party providers. AI-generated suggestions are informational only and do not constitute medical advice. You can revoke integration access at any time via the App or your account settings.
12. Privacy & Data
Your use of CalorieTaker is also governed by our Privacy Policy. Please review it to understand our data collection and usage practices.
13. Analytics & Advertising
By using the App you consent to the collection of analytics and advertising-related information as described in our Privacy Policy. We and our third-party providers (for example, Google Firebase Analytics, Meta/Facebook AppEvents, Google Mobile Ads / AdMob, and RevenueCat) may collect aggregated and event-level usage data, device and app identifiers, and advertising identifiers for product improvement, campaign measurement, and advertising personalization where permitted. Purchase and subscription events may be reported to third-party measurement services (sometimes with an event_id) to support deduplication and conversion attribution.
You can disable analytics collection in the App settings (Settings → Privacy / Analytics) where provided, and you may limit ad personalization using your device settings. Developer/debug builds may emit additional diagnostic events for troubleshooting; these diagnostic logs are not enabled in production releases.
12. Modifications to Terms
We may update these Terms at any time. Significant changes will be communicated via in-app notification or email. Continued use constitutes acceptance of updated Terms.
13. Termination
We may suspend or terminate your access to CalorieTaker if:
- You violate these Terms or applicable laws
- You engage in harmful or abusive behavior
- We discontinue the service (with notice)
14. Governing Law
These Terms are governed by applicable laws. Any disputes shall be resolved through negotiation or, if necessary, legal proceedings.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
16. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and CalorieTaker regarding your use of the App.
